Terms of Use

1. Introduction
This Mobile Application Terms of Use Agreement ("Agreement") is a binding agreement between you ("End User" or "you") and KumaTomo Ltd, a company registered in Hong Kong ("Company"). This Agreement governs your use of the KumaTomo and KumaGuardian mobile applications (collectively, the "Applications"). The Applications are licensed, not sold, to you. BY DOWNLOADING, INSTALLING, OR USING THE APPLICATIONS, YOU:
(A) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT;
(B) REPRESENT THAT YOU ARE 18 YEARS OF AGE OR OLDER, OR THAT A LEGAL GUARDIAN HAS CONSENTED TO YOUR USE OF THE APPLICATION;
(C) AGREE TO BE BOUND BY THIS AGREEMENT.
2. Application Description and Functionality
KumaTomo is a child development assistant designed to foster emotional intelligence and educational growth in children aged 3-18. The app offers conversational support and can be used to practice English using AI technology. KumaGuardian is a companion app for parents to supervise and guide their child's usage by viewing learning metrics and emotional trends.
3. AI Technology Disclaimer and Limitations
The Applications use state-of-the-art large language models (LLMs) to generate real-time responses. Despite careful tuning and safety measures, the AI may sometimes provide incorrect or inappropriate responses. KumaTomo Ltd does not warrant the accuracy or reliability of any content generated by the Applications. Use of the Applications is at your own risk. We disclaim all responsibility for consequences arising from misunderstandings, incorrect advice, or misuse of content.
Parents and guardians are expected to actively supervise their child's use of the Applications through KumaGuardian. We encourage users to report inaccuracies or inappropriate content; we will review such reports and make updates where possible.
4. Third-Party Service and Geographic Limitations
The Applications depend on third-party AI APIs, including services which may enforce regional restrictions. KumaTomo Ltd shall not be liable for any interruptions, degraded functionality, or access limitations resulting from restrictions or outages imposed by such providers.
5. Subscriptions and Refunds
Subscriptions to the Applications are processed via the Apple App Store or Google Play. Payments are non-refundable, even in cases of premature termination or interrupted access during a billing cycle. In the case of permanent interruption of service due to limitation to certain regions by our third party providers subscriptions automatically end after the paid period unless renewed manually. Auto-renew can be managed through the respective app store account settings.
6. License Grant and Restrictions
You are granted a limited, non-exclusive, non-transferable, and non-sublicensable license to use the Applications on your personal device. You may not: (a) reverse engineer or decompile any part of the Applications; (b) distribute, resell, or sublicense the Applications; (c) use the Applications in violation of applicable laws or this Agreement.
7. No Warranty
THE APPLICATIONS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED UNDER LAW, KUMATOMO LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APPLICATIONS WILL BE FREE FROM ERRORS OR THAT ERROR CAN BE CORRECTED.
8. Limitation of Liability
KumaTomo Ltd shall not be held liable for any direct, indirect, incidental, or consequential damages arising from your use of the Applications, including but not limited to data loss, service interruption, or reliance on AI-generated content.
9. Termination
This Agreement remains in effect until terminated by either party. You may terminate the Agreement by uninstalling the Applications. KumaTomo Ltd reserves the right to terminate your access at any time for violations of this Agreement or discontinued service.
10. Updates and Changes
We may modify these Terms of Use from time to time. Continued use of the Applications constitutes acceptance of the modified terms.
